64Digits' games "stolen" for another site
Posted on February 04, 2012 at 04:36 So Stevenup showed this to me: 64Digits games at Brothersoft I was unaware of this, and neither myself, Canadonian, or any other mods I know of (not that I asked anyone, mind you) was contacted by Brothersoft, or gave permission to put games from 64D on their website. Now personally, I don't really care, and if Brothersoft had put my games up there, I'd be like "meh, that's pretty cool that my game is spreading", EXCEPT that they give n o credit to the author, and simply lists "64Digits" as the publisher. (But as the creator of 64Digits, I don't mind that, of course =P) So, I'd like to ask you all what you think should be done about this. 64Digits does not "own" these games - the creators of these games (you all) do. And 64Digits really has no control over Brothersoft taking these games and putting them on their website - the most 64D can really do is say "these games weren't published by 64Digits, stop spreading this defaming information that we would publish such amateur games". But since Brothersoft thinks of 64D as the publisher, I can still contact them and ask them to do some things. Here are some of the options I was thinking of: 1) Leave it alone, and let Brothersoft spread these games. 2) Contact Brothersoft and ask them to update their current game listings to include the ACTUAL author of the game, as well as see if there's a way to integrate their download counts into 64D's. 3) Contact Brothersoft and ask them to remove the games. 4) Sue Brothersoft and hope they settle out-of-court before it gets before a judge or lawyer, and they realize 64D doesn't actually own these games. 5) ??? 6) Profit. Any other ideas? Also, for anyone wondering about the donations from last month, it covered the server for January, and into February. =D

Yeah, thats what flash games do, because people can always steal them unless they make it actually check with the host. Thats a good idea.Can't you put up copyright permissions that deny distribution? Or does that require an official lawyer-written policy to make a claim?

There's loads of sites like this (I didn't know it was such a viable business!) and I guess most sites won't care a heck if you send them a Cease-n-Desist. Or they'll just remove their games since after all it takes like five seconds.
The best thing to do, like some people has already suggested, is to always begin your games with a splash screen that points out some real author information. I do that. Also a link to your own site (or your 64DD page, or your YYG page, or your Myspace or Linkedin page) included somewhere in-game might give you some bonus traffic, hopefully. I haven't seen a single real comment or anything on any of my sidewayshosted games, plus Kirbyvania has less than 100 downloads on Softpedia... and over 3000 downloads on the official mirror I link to in the GMC topic and nearly that much on the YYG Sandbox. |
